Enforcement Agent III

The Regulatory Enforcement Agent III is a certified law enforcement officer within DFA Regulatory Enforcement Division. The Enforcement Agent III possesses statewide law enforcement jurisdiction with primary responsibility for regulatory and criminal violations relating to alcohol, tobacco, and medical marijuana. Regulatory Agent III's oversee and instruct Agent II's in tobacco and alcohol compliance techniques inspections and related investigative methods. Enforcement Agent III's supervise Agent II's and a working group of 10 or more Special Agent I's ensuring adherence to laws, regulations, and agency policies within a designated jurisdictional framework. They are also assigned to oversee one of the agencies internal divisions. The Enforcement Agent III works directly under the supervision of the Regulatory Enforcement Director (Manager) reporting all field or administrative actions within their assigned division.

Typical Functions:

Monitors Enforcement Agent II’s and Enforcement Agent I’s and ensures compliance with pertinent, state, or local laws, regulations, and internal policies. Reports directly to the Enforcement Director (Manager). Directs Agent II’s and Agent I’s routine and unscheduled inspections of facilities, operations, or areas under jurisdiction. Directs and reviews Enforcement Agent II’s and Agent I’s activities involving Issued criminal and regulatory citations, physical arrest of violators, warnings, or other forms of corrective action when identifying violations. Directs and assigns Enforcement Agent II’s and Agent I’s violation reports or complaints regarding potential breaches of compliance, safety, or legal standards. Reviews and insures collected evidence, interviews of involved parties, and detailed investigative reports used for legal or administrative proceedings meet agency policy requirements and legal standards. Collaborate with other law enforcement agencies or other regulatory bodies when necessary to address more complex cases. Serves as a subject matter expert regarding compliance with agency policy and regulations. Conduct educational sessions or briefings for community groups, businesses, and other personnel about new requirements or changes in the law. Actively resolves any conflicts or disputes regarding regulatory compliance or application of law in a fair and transparent manner. Ensures Enforcement Agent II’s and Agent I’s maintain accurate and up-to-date records of inspections, enforcement actions, and investigative findings. Assist in developing, revising, and implementing policies or procedures that enhance overall regulatory compliance. Prepare periodic reports detailing trends, compliance rates, and recommendations for process improvements for agency leadership. Analyze field data to identify systemic or emerging issues, offering recommendations for preventive measures or policy adjustments. Conducts in interagency or cross-sectional meetings to align enforcement strategies with broader public safety or business integrity goals. Review and approval of all annual job performance evaluations submitted by Agent II’s for Agent I’s who are under the Enforcement Agent III’s span of responsibility Prepares annual job performance evaluations for Agent II’s under the span of responsibility of Enforcement Agent III; Directs performance improvement plans implemented for Agent II’s and Agent I’s.

Knowledge, Abilities, and Skills:

In-depth understanding of relevant laws, ordinances, and compliance standards. Ability to objectively analyze situations, collect pertinent evidence, and make informed decisions involving personnel matters, regulatory infractions, and state law. Excellent oral and written communication skills required for report preparation and public instruction and interactions, to include testimony before regulatory boards, commissions, and courts of law. Strong aptitude for conflict resolution and the capacity to engage respectfully and effectively with individuals across varied backgrounds. Expert skill level with data management tools, mobile reporting systems, and general office software used for administrative, regulatory, and law enforcement duties.

Minimum Qualifications:

Bachelor’s Degree in Criminal Justice, Public or Business Administration, or a related field. Relevant experience may be substituted for some or all the formal education. Minimum of 6 years of progressively responsible management experience in law enforcement Must be a Commission on Law Enforcement Standards and Training certified law enforcement officer (Statutory Requirement). Documented experience conducting inspections, investigations, or similar enforcement activities. Demonstrated proficiency in managing both independent and team-based operational duties in the field is essential for handling the varied challenges of this role. Satisfaction of the minimum qualifications, including years of experience and service, does not entitle employees to automatic progression within the job series. Promotion to the next classification level is at the discretion of the department and the Office of Personnel Management, taking into consideration the employee’s demonstrated skills, competencies, performance, workload responsibilities, and organizational needs.

Must be a Commission on Law Enforcement Standards and Training certified law enforcement officer (Statutory Requirement). OTHER JOB RELATED EDUCATION AND/OR EXPERIENCE MAY BE SUBSTITUTED FOR ALL OR PART OF THESE BASIC REQUIREMENTS, EXCEPT FOR CERTIFICATION OR LICENSURE REQUIREMENTS, UPON APPROVAL OF THE QUALIFICATIONS REVIEW COMMITTEE.
